Terms and Conditions

This Page outlines the Terms and Conditions ("Terms") governing the rental of vehicles from Shepherd Motor Dealer and Rentals, located in Providenciales, Turks and Caicos Islands ("Company"). By renting a vehicle from the Company, you ("Renter") agree to be bound by these Terms. Please read them carefully.
1. Rental Eligibility

Age Requirement: All renters must be at least 25 years of age. Drivers between 21 and 24 may be subject to additional fees and restrictions.

Driver’s License: The Renter must possess a valid driver’s license, held for a minimum of 2 years, and provide a copy at the time of rental. International renters must present a valid international driver’s license or a license in English.

Additional Drivers: Any person driving the rental vehicle must be listed as an additional driver in the rental agreement. Additional drivers are subject to the same terms and conditions as the primary renter.
2. Rental Period

The rental period begins when the vehicle is picked up and ends when the vehicle is returned to the agreed-upon location on the specified date and time.

Extensions: If the Renter wishes to extend the rental period, they must contact the Company in advance. Extensions are subject to vehicle availability and additional charges.
3. Vehicle Use Restrictions

The vehicle may only be used within Providenciales unless prior written permission is obtained from the Company.

The vehicle shall not be used:
-
For illegal purposes.
-
To carry passengers for hire or reward.
-
For racing, off-roading, or testing.
-
While the driver is under the influence of drugs, alcohol, or any other substances impairing their ability to drive.

By anyone not listed on the rental agreement as an authorized driver.

4. Fuel Policy

Fuel Level: The vehicle must be returned with the same fuel level as at the time of rental. If not, a refueling fee will be charged.

Fuel Type: The Renter is responsible for using the correct type of fuel. Any damage caused by using the wrong fuel type will be the Renter’s responsibility.
5. Insurance and Damage

Insurance Options: The Renter may purchase optional insurance coverage provided by the Company at the time of rental. This coverage may reduce the Renter’s liability in case of an accident or damage to the vehicle.

Collision Damage Waiver (CDW): Reduces the Renter’s financial responsibility for damage to the vehicle, subject to a deductible.

Personal Accident Insurance (PAI): Provides coverage for the Renter and passengers in case of injury.

Third-Party Liability Insurance: Coverage for damage or injury caused to third parties.

Renter’s Liability: If insurance is declined or if damage is not covered under the purchased insurance, the Renter will be liable for all costs associated with damage, theft, or loss of the vehicle during the rental period.
6. Accidents and Incidents

Accident Reporting: In the event of an accident or damage to the vehicle, the Renter must:

Immediately notify the Company.

Contact local authorities to file a police report.
-
Complete a written accident report and provide all requested information.

Damage to Vehicle: The Renter is responsible for all damages to the vehicle unless they have purchased insurance coverage that reduces their liability.

Theft: The Renter is responsible for any loss or theft of the vehicle. Comprehensive insurance may be available to reduce this liability.
7. Traffic Violations and Fines
The Renter is fully responsible for any traffic violations, parking tickets, or other fines incurred during the rental period. The Company may charge the Renter’s credit card for any unpaid fines, plus an administrative fee.
8. Vehicle Condition and Maintenance

The vehicle will be inspected prior to rental, and any existing damages will be noted on the rental agreement.

The Renter must return the vehicle in the same condition as it was rented, except for normal wear and tear.

The Renter is responsible for maintaining the vehicle during the rental period, including oil and fluid levels, tire pressure, and battery care.
9. Breakdown Assistance

The Company offers roadside assistance within Providenciales in case of breakdowns.

The Renter should contact the Company immediately in the event of mechanical failure or other breakdowns. Unauthorized repairs are not permitted, and the Renter may be liable for the cost of repairs if unauthorized.
10. Late Return

Late Return Fee: If the Renter fails to return the vehicle at the specified time, they will be charged an additional daily rental rate or an hourly fee, as outlined in the rental agreement.

Unauthorized Extensions: If the vehicle is not returned within 24 hours of the scheduled return time without notifying the Company, it will be considered a breach of contract, and the vehicle may be reported as stolen.
11. Security Deposit

A refundable security deposit will be required at the commencement of the rental. The deposit will be refunded upon return of the vehicle in the same condition in which it was rented, subject to any applicable deductions for damages, fuel, or other fees.
12. Cancellation and Refund Policy

Cancellation: Cancellations made at least 24 hours before the scheduled pick-up time will result in a full refund.

Late Cancellations: Cancellations made less than 24 hours before the scheduled pick-up will incur a charge equivalent to one day’s rental fee.

No-Show: Failure to pick up the vehicle without prior notice will result in a charge for the full rental period.
13. Termination of Agreement
The Company reserves the right to terminate the rental agreement at any time if the Renter violates any of these Terms or uses the vehicle in a manner inconsistent with the Agreement. Upon termination, the vehicle must be returned immediately.
14. Indemnification
The Renter agrees to indemnify and hold harmless Shepherd Motor Dealer and Rentals from any and all claims, damages, expenses, or liabilities arising from the Renter’s use of the vehicle during the rental period.
15. Governing Law
This Agreement is governed by the laws of Turks and Caicos Islands. Any disputes arising from or related to this Agreement will be resolved in the courts of the Turks and Caicos Islands.
16. Modifications
The Company reserves the right to modify or update these Terms at any time, and such changes will be effective upon posting on the Company’s website or providing written notice to the Renter.
